Please read these terms carefully before using our service.

1. Acceptance of Terms

PECivilClick is a platform owned and operated by Tercero Tablada Civil and Structural Engineering Inc. ("we," "our," "us," or the "Company"). PECivilClick is a registered DBA (Doing Business As) and is not a separate legal entity.

By accessing or using PECivilClick's website and services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 16 years of age and have the legal capacity to enter into these Terms.

2. Description of Service

PECivilClick provides an online platform for FE Civil exam preparation, including but not limited to:

  • Practice questions and full-length practice exams
  • Study materials and flashcards
  • Performance analytics and progress tracking
  • Study guides and educational content

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. User Accounts

3.1 Account Creation

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

3.2 Account Termination

We may suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity. You may delete your account at any time through your account settings or by contacting support.

4. Subscriptions and Payments

4.1 Billing

Paid subscriptions are billed in advance on a monthly or annual basis. By subscribing, you authorize us to charge your payment method for the subscription fee.

4.2 Price Changes

We may change subscription prices with at least 30 days' notice. Price changes will take effect at the start of your next billing period.

4.3 Refund Policy

We offer a 30-day money-back guarantee. If you're not satisfied within 30 days of your initial purchase, contact us for a full refund. Refund requests after 30 days will be considered on a case-by-case basis.

4.4 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access until then.

5. Intellectual Property

5.1 Our Content

All content on the Service, including text, graphics, logos, questions, explanations, software, and other materials ("Content"), is owned by PECivilClick or its licensors and is protected by intellectual property laws.

5.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Content for personal, non-commercial educational purposes. You may not:

  • Copy, reproduce, or distribute Content
  • Modify or create derivative works
  • Use Content for commercial purposes
  • Share your account or login credentials
  • Use automated systems to access the Service
  • Reverse engineer or attempt to extract source code

5.3 User Content

You retain ownership of content you submit (e.g., feedback, notes). By submitting content, you grant us a non-exclusive, royalty-free license to use, modify, and display such content in connection with the Service.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Share, sell, or distribute exam questions or content
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Impersonate any person or entity
  • Upload viruses or malicious code
  • Harass, abuse, or harm other users
  • Use the Service to cheat on actual licensing exams

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted, secure, or error-free
  • Results from using the Service will be accurate or reliable
  • Using the Service guarantees passing any exam
  • The Service will meet your specific requirements
  • Any errors in the Service will be corrected
  • The content is complete, accurate, or up-to-date

7.1 NCEES Disclaimer and Digital Product Notice

IMPORTANT DISCLAIMER:

THIS IS AN INDEPENDENT DIGITAL EDUCATIONAL PRODUCT. PECIVILCLICK IS NOT AFFILIATED WITH, ENDORSED BY, SPONSORED BY, OR IN ANY WAY OFFICIALLY CONNECTED WITH NCEES (NATIONAL COUNCIL OF EXAMINERS FOR ENGINEERING AND SURVEYING), ANY STATE LICENSING BOARD, OR ANY OTHER OFFICIAL ENGINEERING EXAMINATION BODY.

We do NOT share, sell, or transfer any user information to NCEES or any licensing board. Your personal data and usage information remain solely within our platform and are never disclosed to examination authorities.

Our practice questions are INDEPENDENTLY CREATED for educational purposes and are NOT actual NCEES exam questions. Any references to "NCEES," "FE Exam," or similar terms are used solely for descriptive and educational purposes to identify the type of examination our users are preparing for.

WE DO NOT PROVIDE, DISTRIBUTE, OR STORE ANY NCEES DOCUMENTS OR MATERIALS. PECivilClick does not host, share, or distribute the NCEES FE Reference Handbook or any other official NCEES materials. Our platform includes a PDF viewer tool that allows users to upload and view their own documents. Any documents uploaded by users are stored EXCLUSIVELY in the user's local browser storage and device - NOT on our servers. We have no access to, control over, or responsibility for any documents that users choose to upload. Users are solely responsible for ensuring they have the legal right to use any documents they upload, and for any sharing or distribution of such documents.

THE SERVICE IS A DIGITAL PRODUCT PROVIDED "AS IS" FOR EDUCATIONAL AND PRACTICE PURPOSES ONLY. IT DOES NOT CONSTITUTE PROFESSIONAL ADVICE, GUARANTEE ANY EXAM RESULTS, OR REPLACE OFFICIAL STUDY MATERIALS.

7.2 Prohibition on Sharing PECivilClick Content

WARNING - LEGAL ACTION FOR UNAUTHORIZED SHARING:

All content on PECivilClick, including but not limited to practice questions, explanations, flashcards, study guides, and any other materials, is protected by copyright and intellectual property laws. YOU ARE STRICTLY PROHIBITED FROM:

  • Sharing, distributing, or reproducing any PECivilClick content
  • Posting our questions or materials on any website, forum, or social media
  • Sharing your account credentials with others
  • Screenshotting, copying, or downloading content for distribution
  • Using any automated tools to extract or scrape our content

ANY USER WHO SHARES, DISTRIBUTES, OR REPRODUCES PECIVILCLICK CONTENT WITHOUT AUTHORIZATION WILL BE SUBJECT TO IMMEDIATE ACCOUNT TERMINATION AND LEGAL ACTION, INCLUDING BUT NOT LIMITED TO CIVIL LAWSUITS FOR COPYRIGHT INFRINGEMENT, SEEKING DAMAGES OF UP TO $150,000 PER INFRINGED WORK PLUS ATTORNEY'S FEES AND COSTS.

We actively monitor for unauthorized distribution of our content and will pursue all available legal remedies against violators.

7.3 Assumption of Risk

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE SERVICE IS ENTIRELY AT YOUR OWN RISK. You assume full responsibility for your use of the Service and any decisions or actions you take based on information obtained through the Service. We are not responsible for any exam results, licensing outcomes, career decisions, or any other consequences arising from your use of the Service.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TERCERO TABLADA CIVIL AND STRUCTURAL ENGINEERING INC. (OPERATING AS PECIVILCLICK), ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTY OR CONDITION, EXPRESS, IMPLIED, OR STATUTORY.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID US IN THE THIRTY (30) DAYS IMMEDIATELY PRECEDING THE DATE ON WHICH YOU FIRST ASSERT ANY SUCH CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS LESS.

YOU ACKNOWLEDGE THAT THE SERVICE IS AN EDUCATIONAL TOOL AND DOES NOT GUARANTEE ANY SPECIFIC RESULTS, INCLUDING BUT NOT LIMITED TO PASSING ANY EXAMINATION. THE SERVICE PROVIDER SHALL HAVE NO LIABILITY WHATSOEVER FOR YOUR EXAM RESULTS OR PROFESSIONAL LICENSING OUTCOMES.

9. Indemnification

You agree to defend, indemnify, and hold harmless Tercero Tablada Civil and Structural Engineering Inc. (operating as PECivilClick), its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including but not limited to attorney's fees and legal costs) arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any intellectual property or privacy right; or (d) any claim that your use of the Service caused damage to a third party. This defense and indemnification obligation will survive these Terms and your use of the Service.

10. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in Miami, Florida, in accordance with the rules of the American Arbitration Association. YOU WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS OR CLASS-WIDE ARBITRATION.

You agree that any claim or cause of action arising out of or related to the Service or these Terms must be filed within thirty (30) days after such claim or cause of action arose, or be forever barred.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

  • Posting updated Terms on this page
  • Updating the "Last Updated" date
  • Sending email notification for significant changes

Your continued use of the Service after changes constitutes acceptance of the new Terms.

12. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and PECivilClick regarding the Service.

14. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
